Terms of Use

TL;DR
Notchkin is a one-time purchase on the Mac App Store or Setapp. Buy it once, use it on your Macs. No subscriptions, no accounts. It is provided "as is." Keep your Mac backed up, and if you need a refund, you ask whichever store you bought it from.
The license you get
When you buy Notchkin from the Mac App Store or Setapp, you are granted a personal, non-exclusive license to install and use the app on Mac devices you own or control, subject to the rules of the store you bought it from. The app, its source code, and its artwork remain the property of Daniel Stankowski. You are buying the right to use it, not the app itself.
What you can't do
- You may not reverse engineer, decompile, or modify Notchkin beyond what macOS and applicable law permit.
- You may not redistribute, resell, or sublicense the app.
- You may not remove the developer's name or copyright notices from the app.
Your data, your responsibility
Notchkin stores your notes locally on your Mac. The app keeps 7 rolling daily backups in its sandboxed folder, so you can recover from an accidental edit or a corrupted file from inside the app itself. The developer does not have a copy of your data. There is no server, no account, no cloud sync.
Those in-app backups live on the same Mac as your notes, though, so they will not help if the Mac itself dies. Back up your Mac yourself using Time Machine, iCloud Drive, or whatever tool you trust. You can also export your entire library at any time from the app's Settings menu.
Stores, updates, and refunds
Notchkin is sold through the Mac App Store and through Setapp, in both cases as a one-time purchase and not a subscription. The store you bought from adds its own terms on top of these. If you bought on the Mac App Store, Apple's Standard Licensed Application End User License Agreement applies, and where the two conflict Apple's terms govern the purchase relationship. If you bought through Setapp, your purchase is subject to Setapp's Customer Terms of Use, under which Setapp acts as the merchant of record, collecting payment and delivering the app on the developer's behalf.
Updates come through whichever store you installed from. Mac App Store copies update through the App Store, and Setapp copies update through the Setapp app, both at no additional charge. Refunds are handled by that same store, not by the developer. For a Mac App Store purchase you request a refund from Apple at reportaproblem.apple.com. For a Setapp purchase you request one through Setapp support under Setapp's refund policy, generally within 30 days of buying and before you have opened the app. The developer does not process payments and cannot issue refunds directly.
No warranty
Notchkin is provided "as is" and "as available," without warranties of any kind, express or implied. This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. The developer does not guarantee that the app will be error-free or that it will meet your specific requirements.
Limitation of liability
To the maximum extent permitted by law, Daniel Stankowski is not liable for any indirect, incidental, special, or consequential damages arising from your use of (or inability to use) Notchkin. This includes, but is not limited to, lost data, lost profits, or computer failure.

Changes to these terms
If Notchkin ever changes in a way that affects these terms, this page will be updated and the "Effective" date above will change. Material changes will also be noted in the in-app release notes.
